Extenuating circumstances that can lead to an aggravated DUI charge

Being arrested on allegations of drunk driving can already lead to serious consequences. However, those who are faced with aggravated DUI charges might have a bit more on the line. An aggravated DUI charge is usually the result of extenuating circumstances outside of the typical blood alcohol content — BAC — levels, which can lead to more severe consequences.

Were there minors present?

The safety of minors is a priority in Maryland. If a driver is found to be driving under the influence of alcohol while there are also minors in the car, he or she could face aggravated DUI charges. Anyone under the age of 18 is considered a minor in this situation.

Was the driver’s BAC exceptionally high?

Another extenuating circumstance is if a driver’s BAC is much higher than the legal limit. In Maryland, the legal limit for adult drivers is .08%, so elevated BACs that are significantly higher than this might be grounds for an aggravated DUI charge. Other reasons for an aggravated DUI charge frequently include:

  • Prior DUI convictions
  • Driving on a suspended or revoked driver’s license
  • Excessive speed

An aggravated DUI charge can — and often does — lead to the loss of driving privileges. However, this charge is much more than an inconvenience. Defendants also face lengthy jail time, steep fines and even limitations on future employment opportunities. DUI charges can also proceed much more quickly through the courts than one might expect, so it may be wise to take a proactive stance when it comes to creating a criminal defense.
